The strong defense of the 'Red Hat Enterprise Linux' trademark
is in part a reaction to the fact that RH did not do a very
good job protecting the prior mark: 'Red Hat Linux'

They lost it, and and got burned with bad press of exactly the
sort you encountered

The GPL is not all of the story -- Copyright and trademark
also come into play, as a distribution contains much more than
just GPL content.
